GENERAL TERMS AND CONDITIONS OF SALE

These terms and conditions govern the sales of illustrations by the company Les Esquisseurs.

Article 1 - Prices The prices of our products are indicated in euros including all taxes (VAT and other applicable taxes on the day of the order), unless otherwise indicated and excluding processing and shipping costs. In case of an order to a country other than metropolitan France, you are the importer of the product(s) concerned. Outside the EU, customs duties, local taxes, import duties, or state taxes may be due. These rights and amounts are not the responsibility of Les Esquisseurs. They will be at your expense and are your full responsibility, both in terms of declarations and payments to the competent authorities and organizations in your country. We advise you to inquire about these aspects with your local authorities. All orders, regardless of their origin, are payable in euros. Les Esquisseurs reserves the right to change its prices at any time, but the product will be invoiced based on the rate in effect at the time of the validation of the order and subject to availability. The products remain the property of Les Esquisseurs until full payment is made. Be aware: as soon as you physically take possession of the ordered products, the risks of loss or damage to the products are transferred to you.

Article 2 - Orders You can place an order on the Internet at https://domo-art.com/. r. Les Esquisseurs reserves the right not to record a payment, and not to confirm an order for any reason, especially in case of supply problems, or in case of difficulty concerning the order received.

Article 3 - Validation of your order Any order appearing on the website implies adherence to these General Terms and Conditions. Any order confirmation entails your full and entire adherence to these general terms of sale, without exception or reservation. All the data provided and the recorded confirmation will be proof of the transaction. You declare to have perfect knowledge of it. The order confirmation will be worth signing and acceptance of the operations carried out. A summary of your order information will be communicated to you via the confirmation email address.

Article 4 - Payment Validating your order implies for you the obligation to pay the indicated price. The payment of your purchases is made through the secure payment system PayPal (express checkout).

Article 5 - Withdrawal / Cancellation The majority of the products sold by Lesesquisseurs.com are personalized. These products are manufactured according to the specific and individual wishes of the consumer and are therefore not pre-produced. As these are personalized products, which are manufactured based on an individual choice of the consumer, the latter does not have, in principle, a right of withdrawal for these products. Les Esquisseurs may exclude the following products and services from the right of withdrawal: products manufactured according to the consumer's specifications, which are not prefabricated and which are made based on an individual choice or decision of the consumer, or which are clearly intended for a specific person. By accepting these General Terms of Sale, the Customer expressly acknowledges having been informed of the terms of withdrawal. EXCEPTIONS TO THE RIGHT OF WITHDRAWAL In accordance with the provisions of Article L.121-21-8 of the Consumer Code, the right of withdrawal does not apply to: The provision of services fully performed before the end of the withdrawal period and whose execution began after the consumer's prior express agreement and express waiver of his right of withdrawal. The provision of goods or services whose price depends on fluctuations in the financial market beyond the professional's control and likely to occur during the withdrawal period. The supply of goods made according to the consumer's specifications or clearly personalized. The supply of goods liable to deteriorate or expire rapidly. In case of cancellation by Les Esquisseurs due to non-compliance with the general terms of sale, the management fees retained will amount to 20 euros. In case of return of a package not received at the relay point within the withdrawal period of 14 days, there will be no refund. For non-personalized products: 1. Notwithstanding the above provisions, the consumer, who has a right of withdrawal, may dissolve an agreement relating to the purchase of a product during a reflection period of 14 days without giving reasons. The company may question the consumer about the reason for the withdrawal but cannot force the consumer to state his or her reasons. 2. The reflection period referred to in paragraph 1 begins to run the day after the day on which the consumer, or a third party other than the carrier and indicated by the consumer, has received the product, or

• if the consumer has ordered several products in a single order that are delivered separately: the day on which the consumer, or a third party designated by the consumer, has received the last product;
• if the delivery of a product consists of several shipments or parts: the day on which the consumer or a third party designated by the consumer receives the last shipment or the last part;
• in case of an agreement for regular delivery of products during a certain period: the day on which the consumer or a third party designated by the consumer has received the first product.

Article 6 - Availability Our products are offered as long as they are visible on the website and within the limits of available stocks. For non-stocked products, our offers are valid subject to availability at our suppliers. In case of unavailability of a product after placing your order, we will inform you by email. Your order will be automatically canceled and no bank debit will be made. In addition, the website is not intended to sell its products in large quantities. Therefore, Les Esquisseurs reserves the right to refuse orders of 10 identical articles.

Article 7 - Delivery The products are delivered to the delivery address indicated during the order process, within a maximum period of 30 days. In case of delay in shipment, an email will be sent to you to inform you of a possible consequence on the delivery time indicated to you. In accordance with legal provisions, in case of late delivery, you have the possibility to cancel the order under the conditions and terms defined in Article L 138-2 of the Consumer Code. If in the meantime you receive the product we will proceed to its refund and the shipping costs under the conditions of Article L 138-3 of the Consumer Code. In case of deliveries by a carrier, Les Esquisseurs cannot be held responsible for late delivery due exclusively to the unavailability of the customer after several appointment proposals.

Article 8 - Warranty All our products benefit from the legal guarantee of conformity and the guarantee against hidden defects, provided by articles 1641 and following of the Civil Code. In case of non-conformity of a product sold, it can be returned, exchanged or refunded. All complaints, requests for exchange or refund must be made by email within 30 days of delivery. Always contact us first to better analyze the situation. Following this, the products must be returned to us in the condition in which you received them with all the elements (packaging...). The shipping costs will be refunded on the basis of the invoiced rate and the return costs will be refunded upon presentation of the receipts. However, in some specific cases, sending simple photos can be more than enough (contact us beforehand). The provisions of this Article do not prevent you from benefiting from the right of withdrawal provided for in Article 6.

Article 9 - Responsibility The products offered comply with current French legislation. The responsibility of Les Esquisseurs cannot be engaged in case of non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with local authorities the possibilities of importing or using the products or services you plan to order. Moreover, the company Les Esquisseurs cannot be held responsible for damages resulting from improper use of the purchased product. Finally, the responsibility of Les Esquisseurs cannot be engaged for all the inconveniences or damages inherent to the use of the Internet network, in particular a break of service, an external intrusion or the presence of computer viruses.

Article 10 - Applicable Law in Case of Disputes Any dispute settlement can be made to Les Esquisseurs by email. The language of this contract is French. These terms and conditions of sale are subject to French law. In case of dispute, in the absence of an amicable settlement, the French courts will have sole jurisdiction.

Article 11 - Intellectual Property All designs made by Les Esquisseurs as well as the elements of the website and social networks are and remain the intellectual and exclusive property of Les Esquisseurs. No one is authorized to reproduce, exploit, redistribute, or use for any title whatsoever, even partially, elements of the site whether they are software, visuals, or sounds. Any simple or hypertext link is strictly prohibited without the express written agreement of Les Esquisseurs.

Article 12 - Personal Data Les Esquisseurs reserves the right to collect personal information and personal data about you. They are necessary for the management of your order, as well as to improve the services and information we send to you. They can also be transmitted to companies that contribute to these relations, such as those responsible for the execution of services and orders for their management, execution, processing, and payment. Article 13 - Archiving Proof Les Esquisseurs will archive the order forms and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of Article 1348 of the Civil Code. The computerized registers of Les Esquisseurs will be considered by all concerned parties as proof of communications, orders, payments, and transactions between the parties. These current general terms and conditions of sale are governed by French law and can be modified at any time without notice.

Article 14 - Late Payment Penalties for Professionals In case of late payment by a professional client, late payment penalties will be automatically applied. These penalties amount to a fixed percentage of 5% of the total amount of the unpaid invoice, calculated for each month of delay, a fraction of a month counting for a full month. This penalty is due without prior notice from the day following the payment date indicated on the invoice. In addition to late payment penalties, a flat-rate indemnity for collection costs of 40 euros will also be due, in accordance with current regulations.
